Terms and Conditions

By clicking on the "I agree" checkbox (or similar button) that is presented to you at the time of sign up or purchase order, or by using or accessing myTpen Services you indicate you agree to be bound by this agreement.

Privacy:

The Privacy Policy governs any personal data you provide to us. By using the Services or Sites you agree to the terms of the Privacy Policy.

License:

Subject to your compliance with these terms and the law, you may access and use the Services.

Intellectual Property:

The Sites, all content included in or made available through the Sites and/or Services shall remain the property of myTpen. We reserve all rights not granted under these terms. We expect that all our users respect copyright and other intellectual property rights. If you breach such rights, myTpen reserves the right to remove the offending content or delete your account without notice.

If you, in your sole discretion, provide any feedback to myTpen concerning the functionality and performance of the Sites and/or Services (e.g. identifying potential errors, enhancements or improvements) (“Feedback”), myTpen shall be entitled to use your Feedback for any purpose without restriction or remuneration of any kind with respect to you. If you decide to provide Feedback to myTpen you shall keep this Feedback confidential and not share it with anyone else.

Pre-release version:

We may designate the Sites or Services, or a feature of the Sites or Services, as a pre-release or beta version (“Pre-release Version”). Pre-release Version does not represent the final product and may contain bugs that may cause system or other failures and data loss. We may choose not to commercially release the Pre-release Version. You must promptly cease using the Pre-release Version and destroy all copies of Pre-release Version if we request you to do so, or if we release a commercial version of the Pre-release Version. Any separate agreement we enter into with you governing the Pre-release Version will supersede the provisions on Pre-Release Version set out in this section.

Content ownership:

You retain all rights and ownership of your content. We do not claim any ownership rights to your content. We will only access, view, or listen to your content in limited ways. For example, in order to perform the Services, we may need to access, view, or listen to your content to (a) respond to support requests; (b) detect, prevent, or otherwise address fraud, security, unlawful, or technical issues; (c) improve our Services and (d) enforce these terms.

Account use:

You are responsible for all activity that occurs via your account. Please notify Customer Support immediately if you become aware of any unauthorized use of your account. You may not (a) share your account information (except with an authorized account administrator) or (b) use another person’s account. Your account administrator may use your account information to manage your use and access to the Services. You agree to use the Services in a proper and correct manner according to our instructions in our interface. myTpen reserves the right, without further notice, to refuse to create or to decide to delete an account that provides access to our Services to users that compromise or are likely to compromise the proper functioning of the Sites and/or Services or users that cause prejudice to myTpen in any other way. myTpen equally reserves the right, without further notice, to delete an account or remove content which myTpen considers to be illegal, infringing and/or inappropriate, with or without notification from the appropriate authorities.

Free trial:

The free trial access is granted under the beta testing program. Your usage is limited to a reasonable number of requests or file processing. If your usage exceeds this reasonable use, the Service may be limited, paused or stopped without further notice to you. myTpen may decide to stop the beta testing program at any time or to make the Service available subject to the payment of additional fees. You will be required to submit your payment method and information once the free trial ends. In this case we will notify you. You may stop using the Services at any time. Termination of your account does not relieve you of any obligation to pay any outstanding fees (if any).The content generated through the AI feature is generated by a computer system and may not always be correct.

Warranties of Services and Sites:

The Services and Sites are provided “AS-IS”. To the maximum extent permitted by law, we disclaim and exclude any and all warranties express or implied, including the implied warranties of non-infringement, merchantability, or fitness for a particular purpose. We make no commitments about the content within the Services. We further disclaim and exclude any and all warranty that (a) the Services or Sites will meet your requirements or will be constantly available, uninterrupted, timely, secure, or error-free; (b) the results that may be obtained from the use of the Services will be effective, accurate, or reliable; (c) the quality of the Services or Sites will meet your expectations; or that (d) any errors or defects in the Services or Sites will be corrected.

Liability for Services and Sites, information and templates:

We specifically disclaim any liability for any actions resulting from your use of any Services or Sites. You may use and access the Services or Sites at your own discretion and risk, and you are solely responsible for any damage to your computer system or loss of data that results from the use and access of any Service or Sites. The information and templates provided by myTpen (“we”, “us” or “our”) on www.mytpen.app ("website") are provided for information purposes only. All information on the website is provided in good faith, however, under no circumstance we shall have any liability to you as a result of your use and/or your reliance on the information, templates, Services or Sites.

Liability of myTpen:

myTpen is not liable to you or anyone else for: (a) any loss of use, data, goodwill, or profits, whether or not foreseeable and (b) any special, incidental, indirect, consequential, or punitive damages whatsoever (even if we have been advised of the possibility of these damages), including those (x) resulting from loss of use, data, or profits, whether or not foreseeable, (y) based on any theory of liability, including breach of contract or warranty, negligence or other tortious action, or (z) arising from any other claim arising out of or in connection with your use of or access to the Services or Sites. Nothing in these terms limits or excludes our liability for gross negligence, for our (or our employees’) intentional misconduct, or for death or personal injury.

Applicable law:

For any concern or dispute you may have, you agree to first try to resolve the dispute informally by contacting us at support@mytpen.app .This Notice shall be governed by, and construed in accordance with, the internal laws of India if you are a business user or an individual consumer. If any provision of this Notice, or the application of such term to any person or other than those to which it is held invalid, the remainder of this Notice, or the application of such term to persons or circumstances other than those to which it is held invalid, shall not be affected thereby.

Amendments to Notice:

Please note this Notice may change from time to time. We expect most such changes to be minor, but there may be changes that are more significant. We will post those changes on this page and, if the changes are significant, we will also provide a more prominent notice. Each version will be noted at the top of the page.
