myTpen Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of myTpen websites located at www.myTpen.app and all associated domains or subdomains developed for specific myTpen applications (collectively, the "Sites"), as well as any services, features, applications, software, content, and documentation made available through them (collectively, the "Services").

By accessing or using any part of the Sites or Services, you agree to be bound by these Terms, including any future modifications that may be published from time to time. If you do not agree to these Terms, please do not use the Services.

Please note that editor.mytpen.app is no longer active, and has been replaced by dedicated web interfaces for different apps within the myTpen ecosystem. Continued use of any of these interfaces constitutes acceptance of these Terms.

Privacy

Your use of the Services is governed by our Privacy Policy. By using our Services, you consent to the collection and use of your data as described in the Privacy Policy.

We comply with applicable data protection laws in the United States, India, and other jurisdictions where our Services are used. For detailed information about how we collect, use, and protect your data, please review our Privacy Policy.

License

Subject to your compliance with these terms and applicable laws, we grant you a limited, non-exclusive, non-transferable license to access and use the Services.

Intellectual Property

All content, designs, and functionalities provided by the Sites and Services remain the property of myTpen. Unauthorized reproduction, modification, or distribution of our content or materials is strictly prohibited.

If you provide feedback about the functionality or performance of the Sites or Services ("Feedback"), we may use it without any obligation to you, including for improvements.

User accounts

You are responsible for all activities under your account. Notify us immediately if you suspect unauthorized access to your account. Sharing account credentials is prohibited.

We reserve the right to suspend or terminate accounts for violations, unauthorized access, or suspicious activities without prior notice.

Payment terms

• Payment methods: Payments for subscriptions are processed through Razorpay or Stripe. Accepted payment methods include credit cards, managed securely by these payment integration providers.
• Automatic renewal: Subscriptions for credit card users will automatically renew unless canceled before the renewal date. Users can cancel their subscriptions through the account settings on the myTpen platform.
• Refund policy: Refunds or pro-rated cancellations are not applicable unless myTpen fails to provide the agreed-upon service or if services are disrupted.
• Taxes: All applicable taxes are included in the subscription fees unless stated otherwise.

Free trial and Usage limits

myTpen offers a free trial with limited usage. If usage limits are exceeded or suspicious activity is detected, the account may be temporarily or permanently locked. To continue using the Services, you must upgrade to a paid subscription. Notifications will be sent before the trial converts to a paid subscription.

Fair use policy

To ensure the availability and reliability of our Services, we enforce a fair usage policy. Activities exceeding reasonable usage limits or impacting service stability will result in limitations or account suspensions.

Defects and Service limitations

In the event that you encounter a bug, error, or defect within the application, you agree to report the issue to our support team at support@mytpen.app. Identifying a defect does not entitle you to a refund or give rise to any legal claim against myTpen, except where expressly required by law.

Data privacy for users

We treat data provided by students, educators, and guardians with the highest level of care and compliance. This includes but is not limited to:

• Students: Submissions, assessments, grades and logs.
• Teachers: Profiles, annotations, feedback, and lesson content.
• Guardians: Contact information, communications, and account linkage data.

Prohibited uses

You may not use the Services to:

• Reverse engineer, decompile, or disassemble any part of the platform.
• Bypass access restrictions or authentication mechanisms.
• Attempt to scrape, copy, or mine data without consent.
• Host, display, or transmit unlawful, harmful, or discriminatory content.
• Access or use another user's account without permission.
• Use the Services in any way that violates laws or infringes upon intellectual property rights.
• Interfere with or attempt to disrupt the functionality of the Services.
• Circumvent subscription limitations through shared login credentials or unauthorized multi-user access.

Linked Sites Disclaimer

Our Services may contain links to third-party websites ("Linked Sites"). These Linked Sites are not under our control, and we are not responsible for their content, updates, or availability. The inclusion of a Linked Site does not imply endorsement by myTpen.

Content ownership

You retain ownership of the content you upload or create using our Services. We do not claim ownership of your content. However, to provide the Services, we may need to access, process, or store your content temporarily.

OpenAI-powered features

Our Notes+GPT application integrates OpenAI technology. Content processed through OpenAI is handled according to OpenAI's terms and privacy policies. myTpen does not retain the content processed through these features.

Children's Data and COPPA Compliance

If you are a school or teacher in the United States using myTpen with children under the age of 13, you represent and warrant that you have obtained all necessary parental consents as required under the Children's Online Privacy Protection Act (COPPA).

Service availability

While we aim for continuous availability, myTpen does not guarantee uninterrupted or error-free service. Planned maintenance and unforeseen outages may occur. We are not liable for any losses resulting from downtime.

Copyright Infringement (DMCA)

If you believe any content on our platform infringes your copyright, please notify us in accordance with the Digital Millennium Copyright Act (DMCA). Provide a detailed description of the infringing content and proof of ownership to support@mytpen.app.

Indemnification

You agree to indemnify, defend, and hold harmless myTpen, its affiliates, directors, officers, employees, and agents from any and all claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or in any way connected with:

• Your access to or use of the Services.
• Your violation of these Terms.
• Your content, data, or conduct submitted via our platforms.

Changes to Services and Terms

We may update or modify these terms at any time. Significant changes will be communicated via email or a prominent notice on our Sites. Continued use of the Services after changes indicates acceptance of the updated terms.

Governing law and dispute resolution

These Terms shall be governed by the laws of India. In the event of any dispute or claim, you agree to first attempt to resolve the issue informally by contacting support@mytpen.app. If not resolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts in Salem, Tamil Nadu. We may, at our discretion, require that disputes be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.

Force Majeure

myTpen shall not be liable for any failure or delay in the performance of its obligations resulting from causes beyond its reasonable control, including but not limited to acts of God, power outages, internet service disruptions, labor shortages, governmental actions, or third-party service failures.
